General terms and conditions of service

1. Scope and acceptance of general terms and conditions

Secundo's activities include acting as an intermediary between (prospective) buyers (hereinafter referred to as: service recipients) and property developers, builders and sellers in general (hereinafter referred to as: sellers), as well as with various service providers and suppliers who may provide different types of services in connection with the purchase and fitting out of the property acquired (for example: furniture and/or electrical stores, alarm installers, solar tents, lawyers, etc.; hereinafter referred to as: service providers). More specifically, it is a service of assistance and support to facilitate the purchase and fitting out of the new property of the purchasers to whom we have presented properties.

These General Terms and Conditions of Service (hereinafter also: GTCS) are applicable to the services provided by Secundo in the context of putting service recipients in contact with sellers and service providers, and more specifically services relating to the accompaniment of (potential) purchasers in the context of the purchase of a property.

These GTC govern in particular the scope of the services offered by Secundo, Secundo's obligations and responsibilities in the context of its intermediary activity. They apply to all persons using Secundo's intermediary services.

If you do not agree with these terms and conditions, please do not use this type of service.

The beneficiary of the services acknowledges having read these General Terms and Conditions of Service (as well as the General Terms and Conditions of Use of the website and the Privacy Statement) and undertakes to comply with the obligations incumbent upon him/her.

With regard to the information and images contained on the www.secundo.com website, as well as the activities related to the use of the website, we explicitly refer to the General Terms and Conditions of Use of the website (GTCU), which apply to these aspects.

The GTCS and the GTCS are complementary. However, in the event of any contradiction between the GTCS and the GTCS, the GTCS shall prevail.

2. Secundo's services and commitments

The services which are the subject of the present GTCS are not such as to entail a contractual relationship between the beneficiary of the services and Secundo. These services are optional and provided free of charge.

Secundo makes every effort to find reliable, quality sellers for its matchmaking services. The (potential) buyer of a property presented by Secundo may decide not to use the sellers and/or service providers with whom he/she has been put in contact through Secundo or whom Secundo has presented to them. The sole purpose of the service offered by Secundo is to facilitate the procedures usually associated with the purchase of a property and the beneficiary of the services has the choice of contracting with the intermediaries proposed by Secundo or not.

Secundo undertakes, of course, to comply with all applicable legal and ethical obligations, and to use its best endeavors to fulfill its duty to advise and inform as accurately and completely as possible. In the event of any discrepancy between the information provided by Secundo and that provided by the sellers/providers, the information provided by the latter shall prevail and shall, where applicable, be the sole means of binding the beneficiaries of the services to the sellers/providers.

Secundo is bound by an obligation of means for the services offered and bears no obligation of result of any kind whatsoever.

3. Processing requests and/or information

The beneficiary of the services has the possibility of providing his personal data, in particular to obtain information from Secundo or to put him in contact with sellers/providers.

We reserve the right to restrict, suspend or refuse the processing of information in the following cases:

- incomplete or incorrect information ;

- Communication of obviously erroneous or fanciful data;

The above list is not exhaustive.

In any case, the personal data provided by the beneficiary of the services will be processed solely for the purpose of responding to the requests made by the latter or for offering the services requested, and the personal data of the beneficiaries of the services will only be communicated to third parties if the beneficiary of the services has given his consent or has asked to use the specific service of putting him in contact with third parties.

4. Information provided

The service(s) and goods offered, as well as the information provided, are described and supplied in good faith, as accurately and faithfully as possible. Secundo acts diligently when collecting and transmitting information of any kind.

The images and information presented on the site (hereinafter referred to as the "Information") or provided to Secundo are provided for information purposes only and have no contractual value. Secundo does not guarantee the completeness, accuracy, exhaustiveness or availability of this information or of the services offered, and in particular information concerning real estate advertisements. Secundo cannot be held responsible for the inaccuracy of such information.

Secundo makes every effort to provide quality content that is as reliable as possible. However, information published on this site or communicated regarding products and services may be incomplete, inaccurate or out of date, and Secundo makes no commitment to correct or update communicated information regarding such products and services within a given time frame.

Secundo may make changes to the products and services offered on the site or to the prices applicable to such products and services at any time and without notice, without incurring any liability.

Secundo cannot be held responsible for errors in information transmitted or published, including advertisements. Advertisements and information do not constitute an offer in the legal sense of the term. The information transmitted must be considered provisional and must be confirmed by the sellers and/or service providers. In this respect, the beneficiaries of the services are obliged to request any information they deem useful or necessary from the sellers and service providers.

Secundo draws the attention of the beneficiaries of the services to the fact that Spanish legislation may be applicable to transactions concluded in Spain or with Spanish actors. The applicable laws and rules may therefore differ from Belgian laws and rules, and the beneficiary of the services undertakes to obtain information or to request any information that he or she deems useful or necessary from the sellers, service providers and/or any other specialized actor that he or she deems appropriate.

5. Use of services in good faith

When using the site and services, the recipient of the services is required to act as a good father and is responsible for providing correct and complete information.

6. Limitation of liability

Secundo's activity is limited to introducing sellers and service providers to service recipients. Secundo makes every effort to find reliable, quality vendors and service providers for its matchmaking services. Likewise, Secundo will only introduce service recipients it believes to be reliable to its partners.

Secundo is not a party to any contracts that service recipients may enter into with vendors and/or service providers as a result of Secundo's intermediary services.

The decision to enter into a contractual relationship with the vendors and/or service providers presented by Secundo rests entirely with the recipient of the services and vice versa.

In addition to what is specified in article 4 of these T&Cs, Secundo is therefore not responsible for acts, commitments, failures and/or omissions of any nature whatsoever, including the financial situation or solvency of the beneficiaries of the services, vendors and/or service providers vis-à-vis the other party.

Furthermore, Secundo cannot be held responsible for any delays and/or shortcomings and/or defects, in particular in construction, and/or delivery and other obligations incumbent on sellers and/or service providers.

In general and in any event, Secundo shall not, except in the case of fraud, be held liable for the non-conclusion of a contract with a third party or for the non-performance, even partial, of obligations resulting from the inaccuracy of information communicated, the non-execution of obligations contracted or contracts concluded thanks to access to the Secundo website or thanks to information provided by or via Secundo, as well as any direct or indirect damage resulting therefrom, damage occurring as a result of a case of force majeure, as well as unforeseeable and/or insurmountable facts or acts or failings of a third party.

Without prejudice to the foregoing, in the event that Secundo is held liable, for any reason whatsoever, our liability shall not exceed the total amount of €2,000 Notwithstanding the foregoing, with regard to Secundo's regulated activities, its liability shall in any event and whatever the nature of the fault and/or damage be limited to the amount covered by its professional liability insurance.

7. Miscellaneous clauses

The nullity, invalidity or unenforceability of any of the provisions of the GTCS with the legal or regulatory provisions in force shall not affect the validity of the other provisions of these General Terms and Conditions, which shall retain their full legal force. In the event that one or more provisions of the GTS are declared invalid, void or unenforceable, the provision(s) concerned shall be replaced by another valid provision of similar scope.

The content of the site or services, as well as the General Terms and Conditions and other texts contained therein, may be modified at any time at Secundo's sole discretion. The recipient of the services is bound by such modifications, if any, and is expected to periodically review the changes made thereto.
